Wells Fargo Robocall Class Action Settlement

In August, a Georgia federal judge granted preliminary approval to a $30 million settlement of a robocall class action lawsuit that was filed against Wells Fargo Bank NA. The lawsuit alleged that Wells Fargo violated the Telephone Consumer Protection Act (TCPA) by using an autodialer to call cell phones about account overdrafts. The TCPA prohibits such robocalls unless the consumer provided prior consent to receive such calls. TCPA violations could subject the violator to pay up to $1500 per robocall.

In this case, the plaintiff claimed that she began receiving the spam calls shortly after she obtained a new cell phone number. One defense that Wells Fargo raised was that the phone number previously belonged to a Wells Fargo customer and that the bank had intended to call its customer. Such “wrong number” robocalls can subject the caller to liability. Of course, even after the plaintiff informed Wells Fargo that she was not the person Wells Fargo was trying to call and asked Wells Fargo to remove her number from the bank’s call list, Wells Fargo continued making improper robocalls to the plaintiff.
