For-Profit University Can’t Block TCPA Class Action Claims

In September 2016, an Illinois federal judge refused to dismiss class allegations that for-profit college American Intercontinental University Inc. used illegal telemarketing to recruit students. The proposed robocall class action accuses the university of violating the Telephone Consumer Protection Act (TCPA) by making automated telemarketing calls without receiving consent from the recipients of the calls.

The plaintiff in the robocall class action also is suing Everest University, Everest University Online, Zenith Education Group Inc., ECMC Group Inc. and telemarketing agency John Doe Corporation, claiming that each of those entities also violated the TCPA by making unsolicited and unapproved auto-dialed robocalls. Companies making robocalls or sending spam texts in violation of the TCPA may be liable for up to $1500 per call or text.
