Pizza Hut Franchies Face Spam Text Lawsuit

In August 2016, a Florida federal court permitted a spam text lawsuit to proceed against Pizza Hut franchises. The class action spam text lawsuit accuses the franchises of violating the Telephone Consumer Protection Act (TCPA) by sending unsolicited, spam text message ads.

The lawsuit claims that Pizza Hut franchises sent thousands of unwanted “spam” text messages to consumers’ cell phones. Under the TCPA, business are not permitted to make unsolicited calls or texts to cell phones unless the owners of the cell phone numbers previously expressly agreed to receive such messages. Violators of the TCPA can be held liable for up to $1500 per call or text.
