Medical Device Company Sued for Spam Marketing Faxes

Spam Marketing Faxes Caused iRemedy Health Lawsuit

The iRemedy Health Cos. Inc., a medical device e-commerce company, has been sued in Florida for alleged violations of the Telephone Consumer Protection Act (TCPA) by sending unauthorized and unwanted fax advertisements. The lawsuit alleges that iRemedy faxed numerous unsolicited ads to unaffiliated health care providers without receiving the TCPA- required consent from the fax recipients.

According to the lawsuit, the marketing faxes also failed to provide the opt-out disclosures required by the TCPA, including a notice informing recipients that they have the legal right to opt out of receiving future faxes, the inclusion of a phone number and a cost-free mechanism to which recipients can send opt-out requests, and a notice telling recipients that iRemedy is required to comply with these requests in a reasonable amount of time.

Violations of the TCPA can subject a company to civil damages of between $500 and $1500 per violation.
