Health Service Company Agrees to Spam Fax Settlement

Spam Fax Settlement at $1.35M 

A Florida-based health care provider and one based in Canada have agreed to pay $1.35 million to settle a class-action lawsuit claiming they sent roughly 5,600 fax advertisements that didn’t contain necessary opt-out language, in violation of the Telephone Consumer Protection Act (TCPA). Each violative fax could have subjected the defendants to civil damage claims of between $500 and $1500 per fax.

In its settlement filing, the plaintiff, Medical & Chiropractic Clinic Inc., represented that it had reached a deal with Florida-based radiology provider SRA Ventures and two units of Canada-based cardiology and imaging service provider KMH Labs, against which it had filed a proposed TCPA class action regarding fax advertisements allegedly sent in early 2016.
