Pharmacy Sues Medical Supply Company Over Robofaxes

Robofaxes Result in Lawsuit Against DDP Medical Supply

An Illinois convenience store and pharmacy have filed a putative class action lawsuit against a Florida-based medical supply company, alleging the company violated the Telephone Consumer Protection Act (TCPA) by sending unsolicited fax advertisements. Camp Drug Store Inc. sued DDP Medical Supply, also known as Emily Corporation, alleging that it and more than 39 others received DDP Medical Supply’s unsolicited faxes.

The TCPA prohibits such unsolicited faxes unless the recipient has consented to receive the faxes. The TCPA also requires that such faxes contain a proper opt-out notice. Faxes sent in violation of the TCPA subject the sender to civil damage penalties of $500 fine for each violation.
