Navient Solutions Involved in Class Action Spam Call Lawsuit

An Indiana federal court has been asked to approve a $17.5 million settlement of a Telephone Consumer Protection Act (TCPA) class action lawsuit. The lawsuit accused student loan servicer Navient Solutions Inc. of violating the TCPA by making unwanted robocalls to cell phones. The TCPA prohibits telemarketing robocalls unless the recipient has previously provided consent to be called.

The court already has certified the lawsuit as a class action covering those individuals who received auto-dialed calls from Navient Solutions between May 4, 2011, and March 7, 2016. One of the named plaintiffs in the lawsuit apparently told Navient Solutions a number of times that he was not the person who Navient Solutions was intending to call, but Navient Solutions continued to call the plaintiff.
