Lawsuit Over Alleged Gallup Robocalls

Gallup Inc. has been sued in California federal court for alleged violations of the Telephone Consumer Protection Act (TCPA). The lawsuit accuses Gallup of making automated telephone calls to cell phone numbers that are on the National Do Not Call Registry. The TCPA prohibits companies from making automated marketing calls unless the call recipients previously consented to receive such calls. In its defense, Gallup has claimed that it does not use automatic dialing devices for its marketing calls.

Under the TCPA, consumers can sue for statutory damages of between $500 and $1,500 for each automated call, text, or fax that they received if they have not provided their consent to receive communications.
