JPMorgan Chase to Pay $1.5M in Junk Fax Lawsuit

JPMorgan Chase & Co. agreed to pay $1.5 million to settle a class-action lawsuit that claimed that the bank had violated the Telephone Consumer Protection Act (TCPA) by sending unsolicited fax advertisements to more than 20,000 small business owners in Illinois in 2010.

The junk faxes advertised JPMorgan Chase’s financing product  –  Chase Health Advance. The junk fax lawsuit alleged that the faxes failed to contain a notice allowing the recipients to opt out of receiving the faxes and that there was not any reasonable means for the recipients to avoid receiving the faxes. The members of the class action claimed to have suffered monetary damages because the faxes used up their paper and ink or toner, and that they suffered further because their right to privacy was invaded.
