Frontier Communications Pays to End Spam Call Class Action

Frontier Communications Corp. has agreed to pay $11 million to settle a class-action lawsuit that accused the company of violating the Telephone Consumer Protection Act (TCPA) by making thousands of illegal telemarketing calls. Spam phone calls have become a major nuisance to many and this settlement hopefully will cause Frontier to stop making such marketing calls. It has been reported that the allegedly improper phone calls were made to 36,219 unique cell phone numbers. Each member of the class stands to receive at least $90.

The TCPA prohibits the making of auto-dialed calls to cell phones unless the call recipient has given the caller consent to make the telemarketing calls. Violations of the TCPA can carry statutory damages of $500 for each negligent violation and $1,500 fo reach knowing violation. The lawsuit claimed that Frontier used an automatic telephone dialing system for making telemarketing calls to phone numbers that had been on the National Do Not Call Registry.
