Telephone Consumer Protection Act (TCPA)

Know Your Rights: Telemarketing Laws
  • In most circumstances companies may not make auto-dialed calls (robocall) or send a spam text to your cell phone without your consent.
  • Robocalls or spam texts to consumers must comply with the TCPA. TCPA violations can result in statutory damages of $500 to $1,500 per call or text.
  • Consumer consent to receive a robocall, spam call, or spam text can be written, recorded, or given through electronic means, including website forms or a telephone keypress.
  • Consumers can revoke their consent to receive a telemarketing call in any reasonable way. Companies cannot require you to fill out a form and mail it in to revoke consent.
  • An existing commercial relationship is not consent to receive a robocall or spam text.
  • Urgent calls or texts for health or fraud alerts may be allowed without prior consent. Calls on behalf of tax-exempt, non-profit groups and informational messages, such as school closings or flight information, also are not subject to the TCPA.
  • Telemarketers must provide an automated, interactive “opt-out” mechanism during each robocall or spam text so consumers can tell the telemarketer to stop calling.
  • Consumers can register with the FTC’s national Do-Not-Call Registry to avoid receiving a telemarketing call (www.donotcall.gov). Many states also have do-not-call registries.
  • A robocall uses an automatic telephone dialing system (also known as an autodialer) to dial telephone numbers. Once the robocall has been answered, the autodialer either plays a recorded message or connects the call to a live person.
  • An autodialer is any equipment/software that has the capacity to dial randomly or sequentially. It does not matter how the equipment actually functioned when making the robocall or sending the spam text message. According to the FCC, “. . . the capacity of an autodialer is not limited to its current configuration but also includes its potential functionalities.”
  • Telemarketers are allowed to robocall or spam text a wrong number only once. This commonly comes up when a cell phone number has been reassigned. Companies are responsible for learning whether a number has been reassigned.
